Privacy Policy

Effective April 16, 2026

This policy explains what Kingbird Solutions LLC ("Kingbird," "we," "our") collects when you use kingbirdsolutions.com, what we do with it, who we share it with, and the choices you have. Plain English first, defined terms second. If something here is unclear, email chris@kingbirdsolutions.com.

Section 1

Who we are

Kingbird Solutions LLC is an Arizona limited liability company based in Phoenix. We run this marketing site, sell digital products, and deliver custom software, operations, and AI engagements to businesses. Our mailing address is 11240 N. 19th Ave, Suite 22 PMB 1084, Phoenix, AZ 85029.

Section 2

What we collect

We collect three kinds of information:

  • You give us directly. Your name, email, phone number (if you provide one), company, role, and the content of any message you send through a form, an email, or a booking. If you buy a product, our payment processors collect billing information on our behalf.
  • We capture automatically. IP address, approximate location (city or region), device type, browser, referrer, pages visited, time on page, and anonymous engagement metrics. Vercel Analytics and Vercel Speed Insights collect aggregated performance data without cookies or persistent identifiers.
  • We receive from partners. If you click a link from an advertising, partner, or referral source, we may receive a referral identifier. If you sign up for the newsletter, Beehiiv confirms your double opt-in and engagement with emails.

We do not knowingly collect sensitive categories of personal information (government IDs, health data, financial account numbers, biometrics). Do not send sensitive information through our contact form or email.

Section 3

How we use it

  • Deliver the page, product, or service you requested.
  • Reply to a question, schedule a call, or send a proposal.
  • Send the Field Notes newsletter if you subscribed.
  • Send transactional messages about an order, booking, or engagement.
  • Send sales and marketing messages (email or SMS) if you opted in. See the SMS and email sections below for specifics.
  • Measure what works on the site and improve it.
  • Protect the site from abuse and enforce our Terms of Service.
  • Meet legal, tax, and accounting obligations.

Section 4

SMS and text messaging

We only send SMS with your prior express written consent.

If you provide a mobile number and opt in (by checking a consent box, replying YES to a confirmation text, or agreeing in writing), you authorize Kingbird Solutions and its service providers to send you text messages related to your interest, booking, engagement, or your subscription.

What we send:

  • Transactional messages. Appointment reminders, scheduling confirmations, document delivery notices, and updates tied to an active engagement.
  • Sales messages. Follow-ups about an inquiry, scope conversation, or proposal you have asked us to send.
  • Marketing messages. Product launches, new playbooks, and occasional studio updates, only if you opted in to marketing SMS specifically.

Frequency.

Message frequency varies. Transactional messages are sent as needed. Marketing messages are capped at four per month.

Rates.

Message and data rates may apply from your mobile carrier.

Opt-out.

Reply STOP to any message to opt out of future SMS from that program. Reply HELP for help or email chris@kingbirdsolutions.com. Opting out of marketing SMS does not opt you out of transactional messages for an active engagement; to stop those, email us.

Consent is not a condition.

You are never required to consent to SMS to purchase a product, book a call, or work with Kingbird. Carriers are not liable for delayed or undelivered messages.

Non-sharing.

Mobile phone numbers and SMS opt-in consent data are not shared with third parties or affiliates for marketing or promotional purposes. We share them only with the messaging platforms we use to deliver the messages you requested.

Section 5

Email

If you subscribe to the Field Notes newsletter, we send essays, studio updates, and occasional product announcements. Every email includes an unsubscribe link. Clicking it removes you from the list. We comply with the federal CAN-SPAM Act.

If you are in an active engagement or purchase process, we may send transactional emails (receipts, kickoff calendars, document links) even if you have unsubscribed from marketing. These are necessary for the service.

Section 6

Cookies and tracking

The site uses minimal cookies and similar technologies:

  • Essential. Cookies required for the site to load and function (for example, Next.js session cookies). These cannot be disabled.
  • Analytics. Vercel Analytics and Vercel Speed Insights collect anonymous, aggregated performance data without cookies or persistent identifiers.
  • Embedded services. When you load a Calendly scheduler, a Cal.com embed, a Stripe checkout, or a Gumroad checkout, those services may set their own cookies. Their privacy policies govern their cookies.

Most browsers let you refuse cookies or delete existing ones. Blocking essential cookies may break parts of the site.

Section 7

Who we share it with

We do not sell personal information. We share information only with service providers who help us run the business, and only to the extent needed to deliver a requested service. Current providers:

  • Vercel (hosting, analytics, performance)
  • Beehiiv (newsletter delivery and engagement tracking)
  • Formspree (contact form submissions)
  • Stripe (payment processing for services)
  • Gumroad (payment processing for digital products)
  • Calendly and Cal.com (scheduling)
  • HubSpot (customer relationship management for active prospects and clients)
  • Google Workspace (email, documents, calendar)
  • SMS messaging providers (to send opted-in SMS on our behalf)

We may also disclose information when required by law, to respond to valid legal process, to protect the rights or safety of Kingbird or others, or in connection with a business transfer (such as a merger or sale of assets), with notice to you where practicable.

Section 8

How long we keep it

We keep information as long as needed for the purposes described, to comply with legal and tax obligations, to resolve disputes, and to enforce agreements. Newsletter subscribers remain on the list until they unsubscribe. Sales and customer records are kept for at least seven years to meet tax and contract retention standards. Aggregated analytics data may be retained indefinitely.

Section 9

Your rights

Depending on where you live, you may have rights under state privacy laws such as the California Consumer Privacy Act (CCPA, as amended by CPRA), the Virginia Consumer Data Protection Act, the Colorado Privacy Act, or similar laws in other states. These may include the right to:

  • Know what personal information we hold about you
  • Access a copy of that information
  • Correct inaccurate information
  • Delete personal information we hold about you
  • Opt out of the sale or sharing of personal information (we do not sell or share for cross-context behavioral advertising)
  • Limit the use of sensitive personal information
  • Be free from retaliation for exercising your rights

To exercise a right, email chris@kingbirdsolutions.com with the subject "Privacy Request." We will verify your identity before acting and respond within the timeframe required by applicable law (typically 45 days). You may use an authorized agent. If you are unsatisfied with our response, you may appeal by replying to our response, and in some states you may contact your state attorney general.

If you are in the European Economic Area, the United Kingdom, or Switzerland, you may have additional rights under the GDPR or UK GDPR, including the right to lodge a complaint with a supervisory authority. Our legal basis for processing is typically consent, performance of a contract, or our legitimate interest in running a small business.

Section 10

Children

This site and our services are not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has submitted information, email us and we will delete it.

Section 11

Security

We use reasonable technical and organizational safeguards, including TLS for transport, access controls, and vetted service providers. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security. Report suspected incidents to chris@kingbirdsolutions.com.

Section 12

International users

We are based in the United States. If you use the site from outside the United States, you understand that your information will be transferred to and processed in the United States. Privacy laws may differ from those in your country.

Section 13

Governing law and venue

This Privacy Policy and any dispute arising out of or relating to it or to your use of the site are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. Any such dispute will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and both parties consent to that jurisdiction and venue.

Section 14

Changes to this policy

We update this policy when we change how we handle information. If we make material changes, we will revise the effective date at the top and, where appropriate, notify subscribers by email. Continued use of the site after changes means you accept the updated policy.
